TERMS AND CONDITIONS

RESPONSIBILITY: INTOXICATING TRAVEL GROUP LLC Dba I Travel Group, a Texas corporation acting as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, lodging provider, ground operator, or other service provider named in your itinerary (“ SUPPLIERS”) in selling travel-related accepting services, or in accepting

reservations or bookings for services that are not directly supplied by this Travel Agency (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.). I Travel Group is not responsible for acts or

omissions of such Suppliers or the subcontractors or their failure to provide services, adhere to their schedules, their failure to pay any refund, or failure to comply with any laws such as the Americans with Disabilities Act (ADA), or any intentional, negligent actions or omissions on the part of such suppliers, which result in any loss (including loss of possessions or loss of enjoyment), damage, delay, inconvenience, illness, injury or death to travelers or travelers’ companions or group members which may be caused by any of the following:

 your act(s) and/or omission(s); or the act(s) and/or omission(s) of a third party not connected with the provision of your trip and which were unforeseeable or unavoidable; or ‘force majeure’ as defined in paragraph 9 below  

PROFESSIONAL FEE: To perform the professional services required to design and arrange your travel request, our nominal professional fee is required. This fee is non-refundable and due at the start of the planning process.   Our professional fees are intended to ensure our best clients, like yourself continue to receive the quality of services you have come to expect and deserve.  

Our work is based on years of personal experience and professional expertise. We research cruises, hotels, tours, travel insurance, and activities to meet your specific needs, contact suppliers, coordinate transportation, draft itineraries, and more. We provide custom itineraries, vacation plans, and bespoke creations that give travelers peace of mind and tremendous time savings.

CHANGES TO RESERVATIONS: ANY changes made to a Client’s existing room, tours, and airfare reservations are subject to the current rates, promotions, change fees (including a name change), and terms at the time of change. Any changes requests made on confirmed itineraries are subject to a $25 service charge per change, per person plus any additional fees or surcharges from each supplier. Rate is based on all services performed by I Travel Group and its Representatives. If you have any questions, please do not hesitate to call us.

AIRLINE SCHEDULE CHANGES: Airlines occasionally change their flight schedules, & may even cancel flights entirely

for that time slot booked. These changes are beyond I Travel Group's control. If such a situation occurs; I Travel Group will do its very best to assist you with finding the best possible alternate option(s). If the flight time change is minor (2 hours or less) the airline will automatically make the change (airline policies/rules entitle them to legally do so). I Travel Group and/or its Representatives will notify you of any major changes. Please Note: there may be additional costs to re-book a new flight should the airline cancel or make a major change to your original flight itinerary. I Travel Group IS

NOT responsible for any additional costs or fees imposed by the airlines. It is the responsibility of the passenger to check for last-minute airline flight time changes within 24 hours of departure. I Travel Group IS NOT responsible for changes that may occur within 24 hours of the original flight departure time. I Travel Group DOES NOT guarantee any connections, scheduling, or handling of baggage or other personal effects.

​ITINERARY ACCEPTANCE AND APPROVAL:  Each itinerary must be accepted and approved with your signature before any deposit is taken.   Acceptance and approval MUST be submitted by the requested deadline date listed on the quote. 

If not by the Travel Agency or one of its Representatives on or before the deadline date the price quote along with availability is subject to change.

​FINAL PAYMENT: Final payment on approved/accepted quote MUST be received NO LATER THAN 60 days before departure unless otherwise specified by I Travel Group or its Representatives. Final payments WILL NOT be

automatically charged. The itinerary must have full payment before we will release tickets and/or travel documents.  I Travel Group WILL NOT be responsible for cancellations due to payments made after this date. Late fees will apply as referred to below.

​LATE FEES: Final payments not received before the due date above will incur a $25 per person late fee. All reservations

are subject to cancellation and hotel penalties as described above if the final payment is not received on the due date. Late fees are not covered by travel insurance if purchased and are always non-refundable.

​NON-USE OF COUPONS/FREQUENT FLYER MILES: If you purchase a ticket or tickets containing flight coupons/miles that you may or may not use, the Travel Agency will NOT guarantee that the airline will honor the ticket or tickets, and

you agree to indemnify the Travel Agency and its Representatives against airline claims for the difference between the

full fare for your actual itinerary and the value of the ticket that you purchased.

FOREIGN CURRENCY:  Some itineraries may be executed in more than one country, and the currencies used by those countries may vary and may fluctuate in value until paid in full.  Rates are not verified as accurate, and actual rates may vary.

 CANCELATIONS: All cancelations made by you MUST be in writing. Note an email will be accepted from the main

person listed on the itinerary.  A nonrefundable penalty will be assessed for bookings canceled within 60 days of departure plus any additional supplier/airline penalties. The aforementioned is per person.  If I Travel Group is forced to cancel as a result of unusual and unforeseeable circumstances beyond I Travel Group's control such as force majeure,

the consequences of which we could not have avoided even with all due care. 

​In these bookings conditions, ‘force majeure” means any event in which the Travel Agency, Representatives, or the Supplier of the service(s) in question could not, even with all due care, foresee or avoid.  Such events may include, whether actual or threatened, war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, significant risks to human health such as the outbreak of serious disease, an epidemic or pandemic at the travel destination, adverse weather conditions, fire and all similar events outside our control.  Except where otherwise expressly stated in these booking conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any damage, loss, or expense of any nature as a result of “force majeure”.

LIMITATION OF REFUNDS:  All airlines impose cancelation and change penalties of up to 100% for many discount tickets.  All tour operators, cruise lines, and some resort hotels impose cancelation and change penalties, too.  Please view the applicable rules and cancelation policies listed under each booking type before you approve your booking/reservation.  Note some of the canceled items may be covered if the optional travel insurance policy is purchased refer to paragraph 11 below.

TRAVEL INSURANCE: The best time to buy travel insurance is at the time of your first deposit. The earlier you buy insurance, the bigger your coverage window.  The Travel Agency will include a comparison quote for various travel insurance policies on your initial trip quote for your review. 

A few things you should know about travel insurance:

Benefits vary by plan. It’s important to choose a plan that fits your budget and travel plans. To see some of the definitions of available travel insurance benefits please contact I Travel Group or your travel advisor. 

 

Travel insurance can’t cover every possible situation. Travel insurance is designed to cover unforeseeable events— not things you could easily see coming, or things within your control. If, for example, you wait to buy insurance for your

beach trip until after a named hurricane is hurtling toward your destination, your losses wouldn’t be covered.

​NOTE: Travel Insurance MUST be purchased within 14 days of making your initial trip deposit to be eligible for the pre-existing conditions benefit (not available on all plans.

​TRAVEL DOCUMENTS: Travel documents will be sent to you no later than ten (10) days before the departure date. Please read through these documents immediately; please contact the Travel Agency to report any misspellings, incorrect

dates, times, fares, or rates.  If you don’t report anything before departure the Travel Agency WILL NOT be responsible

for I Travel Group Included in your travel documents (if airfare is purchased through, I Travel Group) are airline electronic ticket receipts (proof of purchase, not boarding passes or actual tickets). Boarding passes are printed at the time of check-in; online with the airline directly, or at the airport when showing a passport & checking in luggage. You must take your travel documents with you in addition to passports and a major credit card for any baggage fees that may apply.

​PASSPORTS: All travelers, which includes children and infants, MUST have a VALID passport to travel internationally

(not a Passport Card). Failure to comply will result in denial of boarding, no refund, and no exceptions (out of the USA). I Travel Group is NOT responsible for passports in ANY way. Passports are required to be valid for 6 months from your return date. PASSPORT CARDS ARE NOT VALID FOR TRAVEL INTERNATIONALLY VIA AIR!  For Passport questions

​TRAVELING WITH CHILDREN: If a child (under the age of 18) is traveling with only one parent or with someone who is

not a parent or legal guardian, U.S. Customs and Border Protection (CBP) strongly recommends that the accompanying adult have a note from the non-traveling parent (or, in the case of a child traveling with neither parent, a note signed by both parents) stating “I acknowledge that my wife/husband/etc. is traveling out of the country with my son/daughter/group.  He/She/They has/have my/our permission to do so.”  

​CBP suggests that this note be notarized.  If there is no second parent with legal custody of the child (e.g. the second parent is deceased, one parent has sole custody, etc.), relevant paperwork such as a court decision, birth certificate naming only one parent, death certificate, etc., would be useful as well.

​While CBP may not ask to see this documentation when the child enters the U.S., the U.S. is very sensitive to the possibility of child abduction and trafficking, and the child and accompanying adult could be detained if questions arise about the situation.  While the U.S. does not require this documentation, many other countries do, and onward travel could be impeded without a notarized permission letter and/or other documentation.  (Canada, for example, has very strict requirements in this regard).  I Travel Group WILL NOT be responsible for any delays or cancelations for your planned travels due to a lack of compliance and improper documentation while traveling.  It is the responsibility of the traveler & the traveler’s parents/guardians to provide the proper documentation to the airport authorities.

 HONEYMOON & ANNIVERSARY TRAVELERS: You MUST bring a copy of your marriage certificate to qualify for any complimentary honeymoon/anniversary package (photocopy is recommended). Failure to have such proof of marriage will result in the resort denying these complimentary privileges (if applicable). PLEASE notify your I Travel Group agent

if you are celebrating a Honeymoon or Anniversary so that they can annotate this in your reservation. Typically, the

resort will honor these packages up to 30 days before or after your honeymoon/anniversary date.

​CRIMINAL HISTORY: There may be some entry and exit restrictions based on each country for visitors. These

restrictions are set forth by foreign governments and include DUIs, health concerns & vaccinations, child safety, and support, offensive actions, or any felony arrest history. It is every traveler's full responsibility to check and verify the entry, exit, passport, and visa requirements. To avoid entry or exit issues please visit https://travel.state.gov/    I Travel Group  WILL NOT be liable if you are denied entry at any country's port of entry.

AIRLINE/AIRPORT INFORMATION:

BAGGAGE: Due to continual changes in airline baggage policies it is suggested that you inquire with your airline's

website for up-to-date fees & information. I Travel Group IS NOT responsible for additional fees incurred for baggage

or seating. BAGGAGE FEES ARE NOT PART OF AN ALL-INCLUSIVE PACKAGE! Please review the "Updated Checked Bag and Carryon Bag Rules" for your airline under the baggage rules section located on their website.

RE-CONFIRM YOUR FLIGHTS: Even though the Travel Agency provides you with a travel app that will give you flight status notifications (if you have downloaded the app and accepted to receive notifications)  I Travel Group strongly recommends you re-confirm your flight schedule within 24 hours before departure directly with the airline in case of

any last-minute changes or delays. Most airlines allow you to check in online 24 hours before departure using the

“Record Locator” (found in your I Travel Group travel documents listed under the confirmation number)

AIRLINE CHECK-IN:  For international travel, a good rule is to arrive at the airport 3 hours before departure and 2

hours for domestic travel.  International flights often start boarding 45 minutes to 1 hour before the departure time. 

Most airlines will close the door to the aircraft 10 minutes before departure time.  For updated travel information and Real I.D. requirements please visit

​DELAYS: Flight delays are very common today.  If your flight is delayed for any reason, the airlines are not required by

law to pay for your en-route expenses, such as meals, hotels, taxis, and phone calls.  I Travel Group is not responsible for any additional incurred costs due to these delays and/or cancelations.  For possible reimbursement for these costs

please refer to paragraph 11 under travel insurance benefits.

​CHARTER:  If your package trip involves a charter flight, or if your vacation involves an air-only charter flight, federal regulations MAY require that you also sign the charter operator’s participant agreement, which will be mailed to you. 

If is extremely important that you realize that, for charters:

 PUBLIC CHARTER FLIGHTS: 

 Departure times (both going and returning) can change at the last minute.  These delays legally can be as much as 48 hours (approximately two days late).

 Your flight may be advertised as non-stop; however, the operator may legally change the routing and make intermediate stops at the last minute.

 The charter operator may legally substitute types of aircraft and even airlines at the last minute.  Charter aircraft are generally not as comfortable as scheduled aircraft.

 The charter operator generally takes no responsibility for baggage it is not unusual to have luggage misplaced.

 Charter trips have a very stiff cancellation penalty policy.  No one plans a trip with the idea of canceling; however, sometimes that becomes necessary and you must understand what to expect or not expect in the way of refunds.

 Usually, no frequent flyer miles are accrued and advance seat assignments are frequently not available.

​PRIVATE CHARTER FLIGHTS:

These terms and conditions shall apply to all charter flights arranged by I Travel Group and shall remain in full force

and effect until terminated in writing by either Party in accordance with these terms and conditions. These terms and conditions do not constitute a commitment on the part of either Party for any specific charter flight unless and until confirmation of a quote for a charter flight (a "Confirmation") is delivered to Client by I Travel Group and accepted by

you, at which time the Parties will be bound by and subject to these terms and conditions and any special provisions set forth in the Confirmation. I Travel Group is acting as an agent to arrange for private charter transportation -an

approved entity that provides or offers to provide air transportation and who has control over the operational functions performed in providing that air transportation, in accordance with Federal Aviation Administration (“FAA”) and Department of Transportation (“DOT”) laws, rules and regulations (a "Direct Air Carrier").

Flights will be operated by a certified Direct Air Carrier licensed by the Federal Aviation Administration with authority from the DOT. Flights will be operated in accordance with Federal Aviation Regulations (“FAR”) Part 135 and the Direct

Air Carrier will have operational control at all times. If the Direct Air Carrier, in its sole discretion, believes that the

safety of the flight may be jeopardized for any reason, the flight may be terminated or refused to commence without any special, consequential, or incidental liability for loss, injury, damage, or expenses occasioned by such termination or refusal. Client shall, at the time of Confirmation, inform the Travel Agency of any allergies, medical restrictions, and/or dietary needs of any passenger. The Travel Agency shall use reasonable efforts to inform Client of any cargo,

refreshment, passenger, or other restrictions or limitations applicable to aircraft to be used for a specific charter; provided, however, that any such restrictions or limitations shall be in addition to, and not in lieu of, any applicable

rules, regulations, approvals, and certifications as provided in the section below headed “Regulations; Identification.” Flight range capability may vary based on the weight of the passengers and their baggage, distance, weather, airport altitude, and runway length. Smoking and the use of illegal drugs are not permitted on charter flights arranged by I

Travel Group.

​REGULATIONS; IDENTIFICATION: These terms and conditions are subject to all applicable rules, regulations, approvals, and certifications in effect which may include, but are not limited to, those promulgated by the DOT, the FAA, and the Transportation Security Administration and that now or hereafter may be imposed or required. Before boarding, all passengers must provide to the Direct Air Carrier at least one form of government-issued photo identification (federal

or state) reasonably acceptable to the Direct Air Carrier in its sole discretion. The client is responsible for informing all passengers of the requirement to provide valid proof of identification and/or citizenship before boarding, and I Travel Group WILL NOT be liable for its reasonable refusal to board any passenger who fails to provide appropriate

identification sufficient for current government regulations, including passport and visa requirements. In addition, minors (individuals under the age of 18 years old on the date of flight) traveling internationally without both custodial parents will require a signed and notarized letter authorizing the travel of the minor from the absent custodial parent(s). The written consent should expressly state the flight itinerary and the absentee custodial parent's signature should expressly permit the minor child/children to fly to the applicable destination for the applicable time period. In cases of sole custody, legal proof of sole guardianship is required. 

​DISCLOSURES: I Travel Group works directly with “Air Charter Brokers” under DOT regulations. I Travel Group acts as the Client’s authorized agent, and in that capacity, I Travel Group will arrange transportation services with a Direct Air Carrier on the Client’s behalf. The client will be the “Charterer” of such air transportation services under DOT regulations. Before the start of the flight, PrivateFly will notify the Client of the flight itinerary, tail number, legal name

of the Direct Air Carrier, and any fictitious names, trade names, or similar other names currently in use by the Direct Air Carrier.

HOTEL/RESORT/TOUR INFORMATION:  intoxicating Travel Group, LLC dba I Travel Group has no special knowledge regarding the financial condition of the Suppliers and unsafe conditions.

CHECK-IN: Check-in time at most resorts/hotels is 3:00 pm (local time). If you arrive before 3:00 pm your room may not be ready. The resort may store your luggage in a secure location on the property so you may start enjoying your vacation without delay. Change into something more comfortable and enjoy a nice lunch, swim in the pool, walk along the beach, etc. until you are notified that your room accommodation is ready for check-in.

In the event of a tariff or rate dispute with one of our suppliers, the traveler must contact I Travel Group or their

booking Advisor at the earliest possible time.

 I Travel Group has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel.  For information concerning

possible dangers at destinations, I Travel Group recommends contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or https://travel.state.gov/content/travel.html.  For medical information, I Travel Group recommends contacting the Centers for Disease Control at (877) FYI-TRIP or https://wwwnc.cdc.gov/travel.  I

understand that I assume complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).  I hereby release I Travel Group from all claims arising out of any

problem covered in this paragraph, and to submit all other claims against us within 30 days after the return of your trip.

I agree that the courts in {Montgomery County} will be the exclusive jurisdiction for all claims brought by me or Intoxicating Travel Group, LLC dba I Travel Group, and I hereby submit to the personal jurisdiction of those courts.

​By embarking upon his/her travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected. A traveler is hereby warned of the above risks as well as possible travel industry bankruptcies and medical and climatic disruptions, and the possibility traveler may be unable to travel as scheduled because of a personal emergency. A traveler is advised to obtain appropriate travel insurance coverage against these risks; information is available through this Travel Agency regarding travel insurance.

Hazards: We have no special knowledge regarding foreign entry requirements, unsafe conditions, health hazards,

weather hazards, supplier bankruptcies, or the suitability of disabled persons for any portion of any tour.

​By accepting and approving this quote/itinerary you hereby release from any claims resulting in whole or in part from

any problem covered in this paragraph and any other causes, not within our control, and submit all other claims against us within 30 days after the return of your trip.

 Package Trips: If you book a trip, we must collect the tour operator, resort, or cruise line’s deposit when reservations

are made. The amount of the deposit, the refund allowed, and the times for canceling vary according to the tour

operator or cruise line. We do not endorse or recommend any particular tour operator or cruise line; our role is strictly limited to facilitating the booking. After you finish your booking, we will send you any agreement required by the travel services supplier, along with a request that you sign that agreement and return it to us. In the event of any inconsistency between that agreement and this agreement, the latter shall govern. 

Information on Website: You agree not to use or authorize the use of this information for any purpose other than

personal use, and not to engage or authorize anyone to engage in the resale, redistribution, and use of the information

on this website for commercial purposes. Third-party links and pointers are included solely for your convenience and

do not constitute any endorsement by us and/or our suppliers. Any software that is on this website including HTML

codes and software made available to download from this website ("Software") is I Travel Group’s copyrighted work or

the copyrighted work of our suppliers or licensors. Other product and company names mentioned herein may be the trademarks of their respective owners.

​Power of Attorney: As our client, you hereby appoint us to be your attorneys-in-fact to sign all documents necessary to purchase and issue airline tickets, tours, cruises, and hotel guarantees for late arrival. You authorize any of the

attorneys-in-fact to sign credit card authorizations for said purchases whenever any of them receives an Internet

booking request reasonably believed to be from you or someone acting on your behalf, requesting those tickets be charged to this credit card account. You agree that you will pay for all such purchases and will not hold us responsible

for any of our actions according to this power of attorney.

​Exclusive Jurisdiction: All suits in connection with, or incident to, this Agreement shall be litigated, if at all, in the courts of the Country of the United States, State of Texas, Montgomery County, to the exclusion of other courts of any other state.

​NO WARRANTIES: THE CONTENT, CODE, ACCESS, AND OTHER FEATURES OF THIS SITE ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF ACCURACY, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY SUCH FEATURES WILL OPERATE UNINTERRUPTED OR IN AN ERROR-FREE FASHION, THAT DEFECTS \WILL BE CORRECTED, OR THAT THIS SITE OR THE SERVER IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

​NO CONSEQUENTIAL DAMAGES: IN NO EVENT WILL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS AND COST OF PROCUREMENT OF SUBSTITUTE PRODUCTS, ARISING OUT OF YOUR USE OR INABILITY TO USE ANY CONTENT OR FEATURES, OR YOUR FAILURE TO ACCESS OR CLICK-THRU ACCESS ANY CONTENT OR FEATURES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION AND EXCLUSIONS MAY NOT APPLY TO
